Terms & Conditions

By accessing or using Cultivarium, you confirm that you accept these Terms & Conditions and agree to comply with them. If you are using the service on behalf of an organization, you confirm that you have the authority to bind that organization to these terms.

Cultivarium is a tool for managing what you grow — including a plant catalog, land and plot mapping, irrigation recommendations, weather data, AI-assisted plant diagnosis, and related features. We may add, change, or remove features over time to improve the service.

To use most features you must create an account. You must be at least 16 years old to use Cultivarium. You agree to provide accurate information and to keep your account details up to date. You are responsible for keeping your password confidential and for all activity that happens under your account. Notify us immediately at info@cultivarium.eu if you suspect any unauthorised use.

Access to Cultivarium is provided through a paid subscription. Pricing is shown on our pricing page and is billed per member of your organization on a recurring monthly basis until cancelled.

Payments are processed securely by Mollie B.V. ("Mollie"), our third-party payment provider. When you subscribe, your payment details are handled by Mollie in accordance with their own terms and privacy policy; we do not receive or store your full card or bank details.

By subscribing, you authorise us, through Mollie, to charge the applicable fees to your chosen payment method on each billing cycle. You are responsible for any taxes that apply to your subscription. If a payment fails or is reversed, we may suspend or limit your access until the amount due is settled.

You can cancel your subscription at any time from your billing settings. Your subscription will remain active until the end of the current billing period, after which it will not renew and recurring charges will stop.

Except where required by applicable law, payments already made are non-refundable, and cancelling does not entitle you to a refund for the remainder of the current billing period. If you believe you have been charged in error, contact us at info@cultivarium.eu.

If you contract as a consumer, you generally have 14 calendar days to withdraw from the contract without giving any reason, counted from the day it is concluded.

Cultivarium is a digital service provided immediately. By accepting these Terms and subscribing, you expressly request that the service begins immediately and acknowledge that, once the service has been fully performed, you lose your right of withdrawal.

To exercise withdrawal while it still applies, email us at info@cultivarium.eu with an unequivocal statement. Where applicable, we will refund you without undue delay and no later than 14 days.

You agree to use Cultivarium lawfully and responsibly. In particular, you agree not to:

• Use the service for any unlawful, fraudulent, or harmful purpose.
• Upload content that is illegal, infringing, or violates the rights of others.
• Attempt to gain unauthorised access to the service, other accounts, or our systems.
• Interfere with, disrupt, or place an unreasonable load on the service or its infrastructure.
• Copy, resell, or commercially exploit the service except as expressly permitted.
• Use automated means to scrape or extract data without our permission.

You retain ownership of the content you create in Cultivarium — including your plants, plots, photos, notes, and growth history. You grant us a limited licence to store, process, and display this content solely to provide and improve the service for you.

You are responsible for the content you upload and confirm that you have the right to use it. We may remove content that violates these terms or applicable law.

Cultivarium, including its software, design, branding, and content we provide, is owned by us or our licensors and is protected by intellectual property laws. These terms do not transfer any of our intellectual property rights to you. You may not copy, modify, distribute, or create derivative works from the service except as expressly allowed.

Some features, such as plant identification, diagnosis, and growing advice, are powered by artificial intelligence and external data sources. These features are provided for guidance only and may be incomplete or inaccurate. You should use your own judgement and, where appropriate, consult a qualified professional before acting on any recommendation. We are not responsible for outcomes resulting from reliance on AI-generated suggestions.

Cultivarium relies on trusted third-party providers to deliver parts of the service, including Mollie for payments, weather and environmental data providers, AI providers, and hosting infrastructure. Your use of those features may also be subject to the providers' own terms. We are not responsible for the availability or performance of third-party services outside our control.

Cultivarium is provided on an "as is" and "as available" basis. While we work hard to keep the service reliable, we do not guarantee that it will be uninterrupted, error-free, or completely secure, or that recommendations and data will be accurate or suitable for your specific situation. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms.

To the fullest extent permitted by law, Cultivarium and its team will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, crops, profits, or revenue, arising from your use of or inability to use the service. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

You may stop using Cultivarium and close your account at any time. We may suspend or terminate your access if you breach these terms, fail to pay, or use the service in a way that may harm us, other users, or third parties. On termination, your right to use the service ends, and we will handle your data in accordance with our Privacy Policy.

We may update these Terms & Conditions from time to time. When we make significant changes, we will update the date at the top of this page and, where appropriate, notify you. Continuing to use Cultivarium after changes take effect means you accept the updated terms.

These Terms & Conditions are governed by the laws of the European Union and the country in which Cultivarium is established, without regard to conflict-of-law rules. Any disputes will be subject to the courts having jurisdiction in that location, unless mandatory consumer-protection laws provide otherwise.
